Back on March 27, 2021, Congress updated the Preventing All Cigarette Trafficking (PACT) Act to include new rules for shipping and selling electronic nicotine delivery systems (ENDS), like e-cigarettes, vapes, flavored and smokeless tobacco. Now, an adult signature is required at delivery. Any business that sells or ships these products across state lines has to register with the ATF and with any states they ship to. We also have to comply with state and local laws regarding excise taxes on these devices. The PACT Act is also in place to prevent online sales of e-cigarettes to minors.
